Recruting policy


INTRODUCTION

It is important to HOUE to protect and respect personal data in accordance with the EU General Data Protection Regulation (GDPR 2016/679) and the Danish Data Protection Act, both of which entered into force on 25 May 2018.

In connection with the recruitment process, we process ordinary personal data about you, but it may also occur that we process special categories of personal data, personal identification numbers (CPR numbers), or information relating to criminal offences. Below you can read more about which information we process about you when you apply for a position with us.



WHEN WE RECEIVE AN APPLICATION FROM YOU

When we receive an application from you, the personal data contained in your application, CV, and any other submitted documents will be registered.

This will typically include information such as: name, address, date of birth, gender, telephone number, email address, CPR number, marital status, education(s), career history, driving licence information, recommendations/references.

We process this information pursuant to Article 6(1)(b) of the GDPR, as these are personal data that you have submitted to us yourself for the purpose of possible employment.

We store the submitted information exclusively in our internal HR recruitment system.



ASSESSMENT OF THE APPLICATION & JOB INTERVIEW

We assess each applicant’s qualifications in relation to the vacant position. Once all received applications have been assessed, we select candidates who will be invited for job interviews. Candidates who are not invited will be informed accordingly.

In connection with the interviews, we receive additional information about you, which we record for the purpose of a possible further recruitment process.



INFORMATION FROM SOCIAL MEDIA

As part of the recruitment process, it may be relevant for us to conduct searches on social media, e.g. LinkedIn, Facebook, Instagram, Twitter, or similar platforms.

We rely on the balancing of interests rule pursuant to Article 6(1)(f) of the GDPR as the legal basis for obtaining information about candidates from social media. This is done in order to assess whether your profile matches our company in relation to the specific position.




INFORMATION FROM PREVIOUS EMPLOYERS

For some positions, it is necessary to obtain references from previous employers. If we obtain references, the information received will be registered.

We rely on your consent pursuant to Article 6(1)(a) of the GDPR as the legal basis for processing this information. You will therefore be asked to give your consent before we contact one or more of your previous employers. You may withdraw your consent at any time. Withdrawal of consent will take effect from the time of withdrawal and will not affect the lawfulness of the processing carried out prior to the withdrawal.




RESIDENCE AND WORK PERMIT

If, due to your nationality, you are required to have a residence and work permit to work legally in Denmark, HOUE will obtain a copy of your passport and your residence and work permit from you. This applies both upon employment and upon renewal. HOUE is obliged to do so pursuant to section 59(5) of the Danish Aliens Act.



STORAGE AND DELETION OF YOUR INFORMATION

If your application is rejected, we will delete the information we hold about you no later than 6 months thereafter.

Unsolicited applications are stored and deleted no later than after 6 months.

For the purpose of possible future employment, we may in some cases wish to retain your application even if you have been rejected. In such cases, we will ask for your consent.

If you are employed, we will store the information that formed part of the recruitment process in your electronic personnel file.




YOUR RIGHTS

Under the GDPR and the Danish Data Protection Act, you have a number of rights in relation to the company that stores and processes your personal data. These rules aim to strengthen the legal position of individuals, including by creating transparency regarding the processing of personal data.

  • You have the right to access the personal data that HOUE processes about you, as well as additional information.
  • You have the right to rectification – i.e. the right to have inaccurate personal data about you corrected.
  • You have the right to erasure – in certain cases, you have the right to have your personal data erased before the time when our general deletion would normally occur.
  • In certain cases, you have the right to restriction of processing of your personal data. If processing is restricted, HOUE may only process the data – apart from storage – with your consent, or for the establishment, exercise or defence of legal claims, or to protect a person or important public interests.
  • You have the right to data portability – i.e. in certain cases, you have the right to receive your personal data in a commonly used and machine-readable format and to request that the personal data are transferred from one data controller to another.
  • If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. Your withdrawal will not affect the lawfulness of processing carried out prior to the withdrawal.
  • If you exercise your rights towards the data controller and your request is not complied with you may contact the Danish Data Protection Agency (Datatilsynet) for guidance on your rights and possibly to lodge a complaint against the data controller.
  • Please note that in certain cases, exceptions may apply to these rights. It is therefore not guaranteed, for example, that you will have the right to data portability in a specific case, or that an objection will be upheld. This depends on the specific circumstances related to the processing activities.
